    Who Is Responsible For The Injuries I Have Suffered At The Workplace?

    Most workplace accidents are reported because of the negligence of the employer. Either the company fails to comply with the standards and laws that bind them or they are too lazy to ensure proper safety for their employees. And only after an accident, their consciousness gets in the frame. If you talk about who is liable for any injury at the workplace, it depends on how the accident occurred. For instance, if you were offered proper training and equipment and your irresponsibility resulted in such an accident, then you cannot hold the company liable for your damages. However, according to a Richmond workers compensation lawyer, for accidents that happened due to lack of training, manpower, or maintenance of machinery, the employer is to be held responsible. And here is why:

    If the employer fails to provide proper training 

    It is the responsibility of an employer and it is legally binding to provide proper training to every employee in the organization. Adequate training helps in improving the efficiency of the employees as well as preventing any accidents due to errors. So if they fail to provide appropriate training, they can be held liable for an accident.

    Fails to adhere to health and safety 

    If you have suffered an injury in your workplace because of any health or safety parameter not being up to the mark, then you can hold your employer responsible for the accident. For instance, your work process involves the release of a toxic gas and you weren’t made aware of it.

    Does not provide safety gears 

    When working with heavy equipment or dangerous systems, you should be fully equipped with protective gear that protects you from any injuries or damage. For instance, someone working in a heavy engineering industry should be provided with proper helmets, whereas people working in gas pipeline should have masks that protect them from hazardous elements.

    No maintenance checkup of machinery 

    Any equipment can suffer wear and tear and stop working or perform abnormally. It becomes the responsibility of the employer to periodically get the machinery checked to maintain its efficiency. In case the accident occurred due to a machinery failure, your employer is to be held responsible.

    Now you are aware of the times when any accident is considered the employer’s mistake. However, you should always be careful of the surroundings and responsibilities at your workplace to avoid any blame shift on you.
